Confidentiality is part of a therapist’s professional duty of care to a client. However in some situations, clients’ needs or the public interest in a specific situation may potentially outweigh the general duty of confidentiality: Prevention of serious harm to the client or to others or a serious crime. The Department of Health offers the following guidance on what counts as serious crime: Murder, manslaughter, rape, treason, kidnapping, child abuse or other cases where individuals have suffered serious harm may all warrant breaching confidentiality. Serious harm to the security of the state or to public order and crimes that involve substantial financial gain and loss will generally fall within this category.
